1. Agreement to Terms
Welcome to arta.io (“Platform”), operated by ARTA LLC (“we”, “us”, “our”). By accessing, browsing or using our Platform and services (“Services”), you (“you” or “Publisher”) agree to these Terms & Conditions and our Privacy Policy. If you do not agree, please cease using the Services.
2. Subscription and License
Subject to your compliance, we grant you a non-exclusive, non-transferable, revocable license to access and use the Platform solely for publishing your content in accordance with these Terms and any applicable Order Form Termly+9arta.io+9Reddit+9iubenda.
3. Publisher Obligations
- You represent and warrant that you:
- Own or control all rights to published content.
- Have obtained all necessary rights, licenses, and permissions (e.g. IP, privacy).
- Comply with all laws (defamation, copyright, privacy).
- You will not upload illegal, infringing, or harmful content.
4. Content Moderation & Removal
We reserve the right, but are not obligated, to monitor content. Upon receiving proper notice of legal infringement, we may remove or disable access to infringing content in compliance with Section 8–10 DDG principles.
5. Third‑Party Links & Content
Our Platform may include links or access to third-party content. We are not responsible for any third-party content and disclaim liability for errors or infringement in such content .
6. Intellectual Property Rights
- You retain all IP rights in your content.
- You grant ARTA LLC a worldwide, royalty-free license to use your content for operating the Platform (display, distribute, backup).
- We retain all rights in our Platform and Services.
7. Fees and Payment
Any fees for use of the Platform or premium Services are outlined in an Order Form. Unless otherwise stated, all fees are non-refundable.
8. Term & Termination
- Term: Begins on acceptance of these Terms and continues until terminated.
- Termination: Either party may terminate for cause, including breach of these Terms. Upon termination, your license ends, and we may delete your content after notice.
9. Warranties and Disclaimers
- ARTA LLC provides the Platform “as is” and makes no warranties (express or implied), including merchantability or fitness for a particular purpose.
- We do not guarantee uninterrupted or error-free operation.
10. Limitation of Liability
To the maximum extent permitted by law, ARTA LLC will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of these Terms or use of the Platform, even if we are advised of the possibility thereof.
11. Indemnity
You agree to indemnify, defend, and hold harmless ARTA LLC, its officers, members and employees, from any claims, damages, liabilities, costs and expenses (including reasonable attorneys’ fees) arising from:
- Your content.
- Violation of these Terms.
- Violation of applicable laws.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA (without conflict with laws). Any disputes shall be resolved in Delaware courts.
13. Changes to Terms
We may update these Terms periodically. Updated Terms will be posted on our Platform with a new “Last updated” date. Continued use after changes constitutes acceptance.
